  1. Terms and Conditions
    • 1.1   Welcome to the Jumeirah Collection. These Terms govern your access of our Website and the opportunity to purchase Products online. You can gain access to the Terms at any time by clicking on the Terms and Conditions link at the bottom of any page on the Website. Please read these Terms carefully before using the Website or purchasing any Product. By using this Website or purchasing any Product, you accept and agree to these Terms. If you do not agree to these Terms, please cease your use of this Website and do not purchase any Product.

    • 1.2   We may amend, delete from or add to these Terms from time to time without notifying you. Amendments posted on the Website will be effective immediately, so please check these Terms regularly. By continuing to use the Website and by purchasing any Products following any changes, you agree to and accept the amended Terms. These Terms were last updated on 26 November 2007.

    • 1.3   In these Terms, the following expressions have the meanings set out:

    • “Hotel Stay” has the meaning given in clause 3.4;
      “Intellectual Property Rights” all intellectual property rights including without limitation copyrights, patents, trade marks, design rights and all similar proprietary rights as may exist anywhere in the world (whether registered or unregistered);
      “Linked Website” the content of any website that may be accessed through this Website whether by hyperlink or otherwise, or any website that allows access to the contents of this Website whether by hyperlink or otherwise;
      “Privacy Policy” the privacy policy applicable to use of this Website and the purchase of Products through this Website;
      “Products” products that may be bought or sold through this Website;
      “Sirius” the recognition and rewards loyalty programme run by us or our affiliated companies;
      “Sirius Points” The reward currency earned by participating in Sirius;
      “Terms” these terms and conditions and the terms and conditions of the Privacy Policy;
      “we”, “us” “our” and “Jumeirah Collection” Jumeirah Retail LLC;
      “Website” the www.jumeirahcollection.com website and its content; and
      “you” and “your” the person using this Website or purchasing Products from it.

  2. Use of the Website
    • 2.1   You are responsible for all of your own use of the Website and for the purchase of any Products through the Website.

    • 2.2   If you are under the age of 18, you may not use this Website or purchase Products through this Website. By using this Website and purchasing Products you agree and represent that you are 18 years old or older. If you are under 18, please contact our Customer Service team to discuss ways that you may purchase a Product.

    • 2.3   If we allow you to set up a unique user name and password for the use of this Website, you are responsible for keeping your login information secret and secure and you agree:

    1. not to permit any other person to use your user name or password; and
    2. not to disclose or provide to any other person your user name, your password or any other information that may allow another person to gain access to your user name or password.
    • 2.4   You must not, and you must not attempt to, interfere with, damage or harm the Website or any network or system underlying or connected to it. You may not use a robot, spider, scraper or other automated means to access the Website or any information on it for any purpose.

    • 2.5   Without limiting any other rights and remedies we have available, we may limit your activities on the Website, deny you access to the Website or refuse to sell Products to you if you breach these Terms or if we consider your use of the Website to be inappropriate.

    • 2.6   If at any time you would like to contact us in relation to the Website, the Products or for any other reason, please contact our Customer Service team or call us on +971 4 3647535 at any time.


  3. Purchase of Products Online
    • 3.1  Purchasing Products online is quick, easy and secure. Before purchasing, you’ll need to register with us by providing a user name and a password as your login information. We will use this information to create your personal account, which you can use to view past orders and view the status of current orders. You will also be able to create your personal address book to make your future order easier and quicker to process. This information will be stored in your account, saving you the effort of entering these details each time you checkout.

    • 3.2  We collect your personal information for the purposes of order fulfilment, and our collection is subject to our Privacy Policy. You may view and amend the personal details registered with us by clicking any My Account link.

    • 3.3  We try to ensure that Products are available in the quantities you require, but can’t guarantee availability. If a Product is not available, you’ll usually be notified during the purchase process and you’ll not usually be able to complete the purchase. If, after you’ve purchased a Product, we find that it is discontinued or otherwise unavailable, we will notify you, cancel your order and refund any payment made.

    • 3.4  If you’ve booked to stay at a Jumeirah hotel within the next three months following the date you wish to make an order for a Product (a “Hotel Stay”), you may request that the Product is delivered to your hotel room during the Hotel Stay, and pay for that Product when you settle your account at that hotel. If you do not stay at the hotel as planned, your order will be cancelled.


  4. Payment for Products
    • 4.1  Subject to the terms set out in this clause 4, you may purchase a Product either with a credit card or with Sirius Points, but not both. Alternatively, if you’ve ordered a Product to be delivered to your room during a Hotel Stay, you’ll be required to pay for the Product when you settle your account at that hotel.

    • 4.2  If you’d like to pay for a Product using cheque, cash or money order, please contact the Customer Service team who will be able to assist you by taking your order over the phone or through e-mail. You should be aware that if you use this method your order may take longer to process than if you purchase Products through the Website.

    • 4.3  If you’d like to purchase a Product using your credit card, the payment will be processed at the time of the order through a secure payment gateway provided to us by a third party bank, which is currently Emirates Bank. Your credit card details will be instantly encrypted for security reasons and directly transferred to the database of the third party bank for authorization. We do not archive your credit card information. This means that you’ll have to enter your credit card information for each purchase. It also means that your valuable credit card information will be safe.

    • 4.4  If you purchase a Product using a credit card:

    1. (you must use a valid credit card issued in your own name;
    2. we currently accept Mastercard and Visa credit cards; and
    3. (c) we are not able to accept any credit card issued in certain countries, which we will try to notify to you at the checkout process;
    • 4.5  If you’d like to purchase Products using Sirius Points, please be aware that:

    1. (a) the purchase will be subject to the terms and conditions of Sirius;
    2. (b) you’ll be required to sign in with your correct name and your Sirius account number and password, and we will require you to follow a further verification process through your email before finalising the purchase; and
    3. (c) following a successful purchase, the Sirius Points used for the purchase will be deducted from your Sirius Points balance.
    • 4.6  All prices for Products are quoted in, and payable in, United States Dollars and Sirius Points. Shipping prices are quoted and payable in United States Dollars. Unless otherwise stated on this Website, all references on it to dollars or $ are references to United States Dollars. Upon completion of the purchase, depending on your selected method of payment, your credit card or Sirius Points balance (as applicable) will be debited, or the cost of the Product will be added to the account for your Hotel Stay at the price current for that Product at the time of your Hotel Stay. If you pay for Products or shipping with a credit card that is not a United States Dollars credit card, the conversion will be done at the rate determined by the third party provider of our payment gateway at the time of purchase and you may be charged further fees by your credit card issuer. We are not liable for any loss, cost or damages you have relating to this conversion.

    • 4.7  We may change the price charged for any Product at any time, except for Products you’ve already purchased.

    • 4.8  If you require us to send a purchased Product outside the United Arab Emirates, your import of that Product may be subject to taxes and restrictions. Any and all taxes, including but not limited to sales taxes or customs taxes or duties are your responsibility. We are not responsible for any such taxes or duties or for any import restrictions.

    • 4.9  Although we have systems to reduce the risk of credit card fraud, we are not responsible for protecting you from credit card fraud. Our fraud protection systems may from time to time block legitimate credit card payments. If your payment is blocked, you’ll be notified either by us or through the Website, and your order will be cancelled. Please feel free to contact Customer Service team in relation to any blocked payments.

    • 4.10  If, after you’ve purchased a Product, we have reason to believe there have been fraud related issues with the purchase, we may cancel the order and stop the delivery of the Product. Our Customer Service team will contact you to attempt to resolve the issue, and will refund the payment or deliver the Product at our sole discretion.


  5. Delivery Policy
    • 5.1  We currently deliver to a limited number of destinations, which are listed in the Shipping Address section of the order form. If the list does not include your destination we may, at our sole discretion, please contact our Customer Service team, who may be able to make alternative arrangements for the delivery of a Product to your preferred destination. We may change the list of destinations that we deliver to at any time without notifying you. If you’ve already paid for a Product and we are notified before we deliver it that applicable law no longer allows us to deliver to the requested address, we will inform you and refund your payment.

    • 5.2  Our delivery charges are based on the order weight and delivery destination, and will be quoted to you at the time of check out.

    • 5.3  Our primary courier company is currently TNT, however we may change this at any time without notifying you. If you wish to use an alternate courier, please contact the Customer Service team who may accommodate this request at their sole discretion.

    • 5.4  We will try to dispatch all orders within 24 hours of payment confirmation. Your order will usually take up to 14 days to arrive. We do not guarantee any of our estimated delivery times and will not be liable to you for delays in receiving your order. Risk in any Product will pass to you on delivery. Ownership will pass to you when you’ve paid all amounts owing to us for the Products and met all other obligations to us under these Terms.


  6. Order Cancellation and Returns Policy
    • 6.1  If you would like to cancel an order after you’ve completed the checkout process, please contact the Customer Service team to assist you. If we have not requested the courier company to send the Product to you, we will cancel the order and refund any payment you’ve made. If we have already requested the courier company to send the Product to you, the order will proceed and you’ll need to return the Product in accordance with this clause 6 and the Return Policy. If you would like to cancel a Product that you have ordered to be delivered and paid for during a Hotel Stay, you may cancel this order by returning the unused Product in its original condition at any time during your Hotel Stay.

    • 6.2  If you are not happy with or no longer require a Product that you’ve purchased and this is not due to our error, unless the Product is of the kind listed in clause 6.4, you may return any unused Product in its original condition and original packaging to us at Our Address within 14 days of receiving it. Please include a copy of the invoice you received with the Product. In these cases, please note that you’ll be required to pay for the cost of returning the Product to us. On receipt of the above, we will provide a refund (less shipping costs) to your credit card or your Sirius account, as applicable. Please allow 30 days for us to process your refund.

    • 6.3  If, after receiving a Product from us, you would like to exchange it for another size or colour, unless the Product is of the kind listed in clause 6.4, you may return it to us at Our Address within 14 days of receiving it. Please include a copy of the invoice you received with the Product. Please note that you’ll be required to pay for the cost of returning the Product to us and the cost of shipping the replacement Product to you. We will replace the returned Product as requested subject to availability and provided that the returned Product is unused and in its original condition. Please allow 30 days for us to replace the Product. If we do not have the replacement Product you have requested, we will contact you and give you the option of another size or colour, or refund you for the cost of the Product.

    • 6.4  We are unable to accept returns of, or replace, the following Products:

    1. creams, lotions, perfumes or any other toiletries that have been opened;
    2. clothing or swimwear that has been worn or had any protective packaging removed;
    3. pillows, beds and linen items; and
    4. monogrammed, personalized or customised items.
    • 6.5  Notwithstanding clause 6.2 or 6.3, if any Product is damaged, broken or otherwise in unusable condition when you receive it, or is not the Product or in the quantity that you ordered due to our error, please return the Product to us within 14 days of receiving it, and we will replace the Product, or, if you ask us to, we will provide a full refund to your credit card or your Sirius account, as applicable, provided that such Product is returned to us within 14 days. We will pay for the cost of shipping it back to us. If you notify our Customer Service team within seven days of receiving the Product, we will arrange for our courier to pick the Product up from you at our cost.


  7. Privacy
    • Please refer to our Privacy Policy, which explains how we will deal with the information we collect from you.


  8. Intellectual Property
    • 8.1  We or our licensors or suppliers own all proprietary and Intellectual Property Rights in the Products, the Website (including but not limited to text, graphics, trade marks, logos, icons and sound recordings) and the software and other material underlying and forming part of the Website. You receive no right, title or interest in such Intellectual Property Rights. You may not, in any form or by any means:

    1. adapt, reproduce, copy, store, distribute, print, display, perform, publish or create derivative works from any part of this Website including but not limited to Product information; or
    2. commercialise, copy, or on-sell any information, or items obtained from any part of this Website including but not limited to Product information.
    • 8.2  Unless indicated otherwise, all names, logos, trade marks, service marks, trade dress and trade names are proprietary to the Jumeirah group of companies (collectively "Jumeirah") worldwide and may not be used by anyone for any purpose without our prior express written consent. We consider our trade marks to be valuable assets, and take infringement of them seriously.

    • 8.3  Where we use registered trade marks owned or licensed by the suppliers of Products, we have used such registered trade marks with the permission of the relevant supplier.


  9. Liability, Warranties and Indemnities
    • 9.1  You warrant that:

    1. you have the legal right, power and authority to agree to these Terms and to purchase any Products offered through the Website; and
    2. any personal information you’ve provided or will provide when registering on the Website is complete, accurate and current, and that you’ll update your personal information held by us if it changes. You must not register under multiple identities or personas (whether false or not).
    • 9.2  You agree that:

    1. to the maximum extent permitted by law, we disclaim and exclude all implied conditions or warranties, including but not limited to any warranties of fitness for a particular purpose. In particular, we do not represent or warrant that the Products will meet any specifications or requirements expressly made known to us by you;
    2. while we use our reasonable endeavours to ensure the availability of the Website and the ability to purchase Products, we do not warrant that the Website or your ability to purchase Products will be uninterrupted, timely or secure. We may require downtime for error correction or maintenance from time to time;
    3. although we intend that information relating to the Products, including but not limited to Product descriptions or the prices listed for Products, we make no warranty or representation as to, and will not be liable for, the accuracy, completeness or reliability of such information;
    4. we are not responsible for any content of advertisements appearing on this Website (including hyperlinks to advertisers' own websites) or any Linked Websites. The placement of such advertisements on the Website does not constitute our recommendation or endorsement of the advertised product or service and we are not responsible for any representation made in connection with its advertisement; and
    5. we will not be liable for any failure to comply with these Terms arising from any cause reasonably beyond our control.
    • 9.3  You agree that, to the maximum extent permitted by law, any and all liability and responsibility of us or any company or entity managed or operated by us, or our or their affiliated, associated or subsidiary companies or the officers, directors, managers, shareholders or staff thereof (together the ”Jumeirah Entities”) to you or any other person under or in connection with these Terms, the Products, this Website, or your use of or inability to use this Website is excluded except as expressly set out in these Terms, regardless of whether such liability arises in contract, tort (including negligence), equity, breach of statutory duty or otherwise, provided that:

    1. your sole remedy in the case of defective or damaged Products will be for us, at our option, to return, replace or repair the relevant Product; and
    2. in the case of any Products provided by third party suppliers, we will pass on to you the benefit of any warranties we receive from those suppliers.
    • 9.4  Our and the Jumeirah Entities’ liability and responsibility is excluded in respect of any and all loss or damage, whether direct or indirect, including, without limitation, loss of profits, loss of data, loss of business or anticipated savings, general and special damages, and consequential and incidental loss.


  10. General
    • 10.1  You and Jumeirah Collection are independent contractors, and no agency, joint venture or partnership is created by these Terms.

    • 10.2  Jumeirah Collection may assign its rights and obligations under these Terms, however you may not assign any part of your rights and obligations under the Terms without our prior written consent.

    • 10.3  Each right or remedy of Jumeirah Collection in these Terms is without prejudice to any other right or remedy we have whether under these Terms or otherwise.

    • 10.4  If we do not exercise or enforce any right available to us under these Terms, it does not constitute a waiver of those rights.

    • 10.5  If any provision of these Terms becomes or is held to be invalid, unenforceable or illegal for any reason, and in any respect, that provision will be severed from the remaining Terms, which will continue in full force and effect.

    • 10.6  These Terms supersede all previous conditions, understandings, commitments, agreements and representations and constitute the entire agreement between the parties relating to the subject matter of these Terms. If during a Hotel Stay you are subject to any terms and conditions in relation to the Products that are inconsistent with these Terms, these Terms will prevail to the extent of that inconsistency.

    • 10.7  These Terms are governed by and construed in accordance with the laws of the Emirate of Dubai and the laws of the United Arab Emirates applicable in the Emirate of Dubai.
