Definitions

“Disqualified Participants” are all people under the age of 18 years (who have not obtained the consent of their guardian) where the prize incorporates air travel, or any other element which would be illegal to supply to a person under the age of 18 years

“Immediate Families” includes spouses, grandparents, parents, children, and grandchildren whether by marriage, and past marriages, remarriage, adoption, co-habitation or other family extension.

“Jumeirah” means all companies in the Jumeirah Group including but not limited to Jumeirah International LLC, Jumeirah Retail LLC and Jumeirah Restaurants LLC and all brands and operating companies controlled by or associated with those entities.

Participation

• These promotion or competition rules (the “Rules”) apply to all Jumeirah promotions or competitions (collectively the “Promotion”) conducted by Jumeirah by means of any medium including but not limited to radio, television, print, telephone or computer. The Rules may change from time to time without notice to you.
• If a particular Promotion has specific rules or terms (“Promotion-Specific Terms”) those Promotion-Specific Terms will also apply to the Promotion and, unless stated otherwise, will over-ride to the extent of any inconsistency with these Rules.
• The Promotion will run for the duration set out in the Promotion-Specific Terms or any promotional material associated with the Promotion.
• Unless otherwise stated in the Promotion-Specific Terms, participation in the Promotion, registration or entry is limited to one per person. Where multiple entries are acceptable, each must be made as a separate entry.
• By participating in the Promotion you are deemed to have accepted the Rules and the Promotion-Specific Terms (if any), and you are deemed to have confirmed that you have the necessary authority (for example from the bill payer or owner of a telephone) to participate in the Promotion. If you do not agree to the Rules and any applicable Promotion-Specific Terms, you should not participate in the Promotion.
• The Promotion is open to those people who are residents of the UAE only, unless specified otherwise in the Promotion-Specific Terms. Disqualified Participants may not participate in the Promotion.
• Jumeirah reserves the right to exclude any person from participating in the Promotion on reasonable grounds.
• Jumeirah reserves the right to refuse to award any prize or benefit to an entrant who Jumeirah decides (in its sole discretion) has:
  1. violated the Rules or the Promotion-Specific Terms;
  2. gained unfair advantage in participating in the Promotion; or
  3. won any prize or gained any benefit in relation to the Promotion by using fraudulent means.
• All personal details of participants provided in connection with the Promotion will be held by Jumeirah and may be used for the purpose of the Promotion and for future promotion and marketing purposes in accordance with Jumeirah’s Privacy Policy, unless otherwise directed by participants at the time of entry.
  
  

Jumeirah’s Responsibility

• Jumeirah reserves the right to extend or discontinue a Promotion at any stage, for any reason.
• Jumeirah disclaims any responsibility for your inability to enter, complete or continue the Promotion due to equipment or technical malfunction, busy lines, inadvertent disconnection, acts of God or otherwise.
• To the fullest extent permitted by law, Jumeirah will not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) or for personal injury as a result of Promotion entry or winning any Promotion prize.
• These Rules will be governed by the laws of Dubai and the Federal laws of the United Arab Emirates applicable in Dubai.

The following is applicable only to Promotions that involve winning prizes:

Winning the Prize

• The prize is as described in the Promotion-Specific Terms and/or other any advertising material relating to the Promotion.
• Only the person who originally entered the Promotion and is deemed by the judges to have won the Promotion can be awarded the prize (the “Winner”).
• Disqualified Participants and all Jumeirah employees, all employees of participating sponsors or promoters and/or advertising agencies and their Immediate Families may not participate in any competition involving a prize.
• By participating in any Promotion involving a prize, entrants grant Jumeirah exclusive permission to use their names, characters, photographs, voices and likeness in connection with the Promotion and for future promotion and marketing purposes and waive any claims to royalty, right or remuneration for such use.
• The Winner will be determined by the judges in accordance with the Promotion-Specific Terms (if any). The judge’s determination of the Winner will be final and no correspondence will be entered into.
• Jumeirah may notify the Winner either by email, phone (voice or text) or mail. If:
  1. the Winner cannot be contacted by phone after three attempts;
  2. the Winner does not acknowledge the notification within two weeks; or
  3. mail sent to the Winner’s address is returned,
• then the notification will be regarded as forfeit, and another Winner will be selected by the judge.
• The Winner must be available for the preparation of all publicity material and participation in all publicity events that may be required by Jumeirah.
• The prize is not redeemable for cash or transferable. No other family members, friends, office associates or any other person will be able to receive the prize on the Winner’s behalf. In the event that the prize specified in the Promotion becomes unavailable for any reason, Jumeirah may substitute a prize of similar or equal kind or value. Where the prize incorporates air travel, unless otherwise specified the air travel is economy class, and will not include airport transfers, accommodation, spending money or any other benefits, and the Winner is responsible for arranging their own passport and visa, if required.
• Where the Winner is required to claim the prize in person, they must provide proper identification (for example driver’s licence, passport or birth certificate). If the Winner is under the age of 18 years their parent or guardian must give their prior written consent to the award of the prize.
• If the Winner is unable to receive the prize in accordance with these Rules or the Promotion-Specific Terms, the judge may select another Winner.
• The Winner takes the prize entirely at his/her own risk and, to the extent permitted by law, indemnifies Jumeirah in respect of any claim for any accident, injury, property damage or loss of life that may occur in connection with the prize. The Winner is responsible for all insurance, tax or any other costs that may be associated with the prize.
